How Can I Get an EIC From Previous Years?

The Earned Income Tax Credit, or Earned Income Credit, is geared for low to moderate wage earners. Individuals who qualify for the EITC are credited a sum of money on their taxes. This usually means lower tax liability, which could result in a larger refund, even if you did not have federal income tax withheld. Taxpayers may claim the EITC retroactively for up to three years by filing an amended tax return.

    Determine whether you were eligible for, but did not claim, the EITC in the last three years. Visit the Internal Revenue Service website and search the forms and publications page for the EITC requirements in each prior year. Alternatively, call the IRS at 800-TAX-FORM (800-829-3676) to request the prior year's forms, or talk to a tax professional.

    Collect your income tax records. You will need information from income tax returns filed in previous years. If you did not file a tax return in the prior year, gather your income records such as your W2s, 1090s and pay stubs.

    Obtain a Form 1040X (Amended U.S. Individual Income Tax Return) and the 1040X instructions. This form and the instructions are available on the IRS website, in some local libraries during tax time and at the office of your tax professional. You must obtain a paper copy because the form 1040X cannot be filed online.

    Obtain the Schedule EIC and tax return instructions for the years in question. If you qualify for the EITC because you are raising a qualifying child, you will need to complete Schedule EIC form and attach it to your 1040X to claim the tax credit. The Schedule EICs and instructions for previous years are also available on the IRS website.

    Complete the Form 1040X and Schedule EIC. The 1040X form is used to amend prior tax returns. You will amend your prior tax return by claiming the EITC credit on the EITC line of the 1040X. Calculate the EITC by consulting the tax return and instructions for the year in question. The 1040X is not difficult to complete, but if you need assistance call the IRS at 800-829-1040.

    File the Form 1040X and Schedule EIC with the IRS. Mail your amended return to the tax processing center listed on the 1040X.
